Welcome to MrLearny! These Terms of Use ("Terms") govern your access to and use of MrLearny's AI-powered learning platform, including all features, content, and services (collectively, the "Service").

By accessing or using MrLearny, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

Service Provider

Eligibility

To use MrLearny, you must:

• Be under 18? Use the Service under parental supervision

Intellectual Property

Our Content

All content, features, and functionality of MrLearny (including but not limited to software, text, graphics, logos, icons, images, audio clips, and data compilations) are the exclusive property of CODE D or its licensors and are protected by Croatian and international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of all content you upload to MrLearny ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Process and analyze your content to provide the Service
• Generate AI-powered questions and feedback
• Improve our AI algorithms (in anonymized form)

AI-Generated Content

MrLearny uses AI technology (including OpenAI's GPT models) to generate educational content. You acknowledge that:

• AI-generated content may not always be 100% accurate
• You should verify important information from authoritative sources
• AI responses are based on patterns and may contain errors
• MrLearny is a learning tool, not a substitute for professional advice

Subscription and Payment

Free Tier

MrLearny offers a free tier with limited features, including:

• Limited questions per day
• Basic AI features
• Standard support

Premium Subscription (if applicable)

Premium plans may include:

• Unlimited questions
• Advanced AI features
• Priority support
• Detailed analytics

Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method automatically
• Prices are subject to change with 30 days notice

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

Limitation of Liability

Indemnification

You agree to indemnify, defend, and hold harmless CODE D, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

Termination

By You

You may terminate your account at any time by contacting us at info@codedesign.hr or through your account settings.

By Us

We may suspend or terminate your access to the Service immediately, without notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse the Service or other users
• Fail to pay applicable fees

Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• You remain liable for all charges incurred before termination

Dispute Resolution

Informal Resolution

Before filing a formal claim, you agree to try to resolve disputes informally by contacting us at info@codedesign.hr. We will attempt to resolve disputes in good faith.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Rijeka, Croatia.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending you an email notification (for significant changes)

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CODE D regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control.
